THE CONNECTICUT HOME IMPROVEMENT ACT, C.G.S. SECTION 21-418 ET SEQ.

Many Connecticut homeowners, contractors and subcontractors have no idea that this law exists, even though it can profoundly effect their rights and responsibilities. Under this technical statute, despite doing top quality work, a contractor risks receiving no final payment if the contractor does not use a contract form that complies with this statute. Licensing / registration requirements are also very strict concerning Home Improvement contractors in Connecticut.

Subcontractors have rights and responsibilities different from contractors in several respects. Many construction jobs are classified as "home improvements" under this law even though contractors consider them to be otherwise. There is lot to know to do things right.

Don't be the unwitting victim of this little-known law, or fail to use it to protect yourself if you have been victimized by a contractor. Whether you are a homeowner, contractor or subcontractor, know what your legal duties and rights are before you suffer losses.

There is also a state fund for victimized homeowners who have obtained judgments and cannot collect them via judgment execution. Special rules determine who can be reimbursed from this fund, up to $15,000.00 per loss.

CONNECTICUT MECHANICS LIENS, C.G.S. SECTION 49-33 ET SEQ.

In Connecticut contractors and subcontractors are protected by this law which gives them 90 days from their last date on the job to serve and record the proper notice and lien. The lien then becomes an encumbrance on the real property for which the work and material was provided, effectively blocking the property owner's ability to refinance or sell for up to one year.

This lien can be foreclosed prior the end of the one year period. A property owner who has a mechanics lien recorded against their property can bring an action to challenge the lien.
